Introduction

This website is operated by SUNNILAND PATIO, INC. under the store brand ZUNQEVARO. Throughout these Terms, “ZUNQEVARO,” “we,” “us,” and “our” refer to SUNNILAND PATIO, INC.

These Terms of Service govern your access to and use of our website, online store, product information, checkout features, customer support, and related services collectively referred to as the “Services.”

Our online store is hosted through Shopify, which provides the ecommerce technology used to make the Services available.

By visiting the website, creating an account, placing an order, or otherwise using the Services, you agree to these Terms and our Privacy Policy. If you do not accept them, please discontinue use of the Services.

1. Eligibility and Customer Accounts

You must be at least the legal age of majority in your state, province, or country of residence to make a purchase through the Services. If you permit a minor to use a device or account under your control, you remain responsible for that use.

When creating an account or submitting an order, you agree to provide complete, accurate, and current information, including your name, email address, billing details, shipping address, and payment information.

You are responsible for:

Restricting unauthorized access to your account
Reviewing activity conducted through your account
Informing us promptly if you suspect unauthorized use

Natural differences in materials or surface textures
Manufacturing updates that do not materially alter the product’s intended function

Measurements shown on the website may be approximate unless specifically stated otherwise. Customers should review all available specifications and confirm that a product is suitable for the intended space before purchasing.

We may revise product information, correct descriptions, limit quantities, or discontinue merchandise without advance notice.

4. Orders and Acceptance

Submitting an order represents an offer to purchase the selected merchandise. An automated order confirmation only acknowledges that we received your request; it does not necessarily mean that the order has been accepted.

An order is accepted after:

Payment has been successfully authorized
Product availability has been confirmed
Any applicable order review has been completed

We reserve the right to reject, limit, or cancel an order for legitimate reasons, including:

Product unavailability
Incorrect pricing or product information
Suspected fraud or unauthorized payment activity
Shipping restrictions

Errors affecting the order

If we cancel an order after payment has been collected, the appropriate amount will be returned to the original payment method.

5. Prices, Taxes, and Payment Information

Unless the checkout page states otherwise, prices are displayed and processed in United States Dollars (USD).

Product prices, promotional offers, and discounts may change without prior notice. The amount shown in your confirmed order applies to that transaction, subject to correction of clear pricing or technical errors.

Unless expressly included, listed prices do not cover:

Shipping charges
Sales, use, or similar taxes
Customs duties
Import fees
Brokerage charges
Currency-conversion or bank fees

You agree to provide valid billing and payment details and confirm that you are authorized to use the selected payment method.

Available payment methods are displayed during checkout. Payments are processed by authorized third-party providers. ZUNQEVARO does not directly retain complete payment-card numbers on its store systems.

6. Promotions and Discount Codes

Promotions may be subject to separate eligibility rules, expiration dates, product restrictions, or minimum-purchase requirements.

Unless expressly permitted:

Promotional codes cannot be exchanged for cash
Multiple codes cannot be combined
Discounts cannot be applied after an order has been submitted
Offers cannot be transferred or reproduced for unauthorized use

If promotional terms conflict with these Terms, the conditions displayed with the applicable promotion will control for that offer.

We may modify or end a promotion where permitted by law, but such changes will not affect qualifying orders already accepted.

7. Shipping and Delivery

Order preparation, shipping charges, estimated transit times, international duties, and delivery procedures are described in our Shipping & Delivery Policy.

Delivery dates are estimates and may be affected by carrier operations, severe weather, customs inspections, holidays, address problems, or circumstances outside our reasonable control.

Customers are responsible for entering a complete and accurate delivery address. Contact us promptly if an address correction is required. Changes may no longer be possible after fulfillment begins.

Risk of loss and legal title will transfer according to applicable law and the terms governing the shipment. Nothing in this section limits rights that cannot legally be waived.

8. Returns, Refunds, and Order Problems

Returns and refunds are handled according to our Return & Refund Policy.

Customers must obtain return authorization before mailing merchandise. Products sent without approval or to an address not included in our return instructions may be refused.

If merchandise arrives damaged, defective, incomplete, or different from what was ordered, contact us promptly and provide the requested order details and photographs.

These Terms do not restrict any mandatory consumer rights available under applicable law.

9. Product Assembly and Appropriate Use

Some outdoor furniture may require assembly. Customers are responsible for following the instructions supplied with the product and using the correct components and hardware.

Before use, customers should:

Confirm that all components are installed correctly
Tighten and periodically inspect applicable hardware
Place furniture on an appropriate, stable surface
Follow any care, storage, and maintenance instructions
Discontinue use if damage or structural instability is observed

Products must not be modified or used for purposes inconsistent with their intended design. Damage caused by improper assembly, misuse, neglect, unauthorized alteration, or failure to follow instructions may not qualify as a manufacturing defect.

10. Ownership and Intellectual Property

The website and its contents—including text, photographs, graphics, layouts, videos, product descriptions, collection names, design elements, and other materials—belong to ZUNQEVARO, its affiliates, licensors, or content providers and are protected under applicable intellectual-property laws.

You may access this content for personal shopping and informational purposes only.

Without written authorization, you may not:

Reproduce or republish website content
Copy product photographs or descriptions
Create unauthorized derivative materials
Distribute, sell, sublicense, or commercially exploit content
Remove ownership, copyright, or attribution notices
Use ZUNQEVARO branding in a way that suggests sponsorship or affiliation

No provision of these Terms transfers ownership of any intellectual property to you.

11. Shopify’s Role

The ZUNQEVARO store uses Shopify technology to provide ecommerce and checkout functionality. However, purchases made through this store are transactions directly between the customer and SUNNILAND PATIO, INC.

Shopify is not the seller of ZUNQEVARO merchandise and is not responsible for fulfilling orders, providing products, handling returns, or resolving claims concerning products purchased from us.

Certain information may be processed by Shopify to operate and improve the Services. Such processing is further described in our Privacy Policy and Shopify’s Privacy Policy.

12. Third-Party Services and Optional Features

The Services may provide access to features operated by third parties, including payment processors, shipping providers, tracking systems, analytics services, and social-media tools.

These services may be governed by separate terms and privacy practices. We do not control every aspect of third-party platforms and do not guarantee that they will always remain available, uninterrupted, or error-free.

Your use of an optional third-party feature is at your discretion and may require acceptance of that provider’s terms.

Our website may contain links to websites that are not owned or controlled by ZUNQEVARO.

Links are provided for convenience and do not automatically represent an endorsement. We are not responsible for the availability, content, security, products, or privacy practices of an independent website.

Before purchasing from or providing information to another website, review its applicable terms and policies. Questions about third-party products or services should be directed to the relevant provider.

14. Reviews, Suggestions, and Customer Content

If you submit a review, photograph, comment, suggestion, or other material to us, you confirm that:

You created the content or have permission to submit it
The content is accurate and not intentionally misleading
Any incentive or compensation connected to the submission has been disclosed
The content does not violate another party’s rights
The content does not contain unlawful, abusive, or malicious material

To the extent permitted by law, you grant ZUNQEVARO a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to reproduce, adapt, publish, distribute, display, and otherwise use submitted content for operating, improving, and promoting the Services.

We may moderate or remove customer content, but we are not obligated to publish, retain, respond to, or compensate you for a submission.

15. Corrections and Availability

The website may occasionally contain typographical mistakes, outdated details, inventory discrepancies, or incorrect information involving pricing, promotions, shipping costs, availability, or product descriptions.

We may correct such information and update or cancel an affected order where reasonably necessary. If an accepted order is canceled because of our error, any collected payment for the canceled merchandise will be refunded.

We are not obligated to update every item of information unless required by law.

16. Prohibited Conduct

You must not use the Services to:

Commit or promote unlawful activity
Infringe copyrights, trademarks, privacy rights, or other legal rights
Harass, threaten, defame, or impersonate another person
Submit fraudulent or misleading information
Distribute spam or unauthorized solicitations

Termination does not eliminate obligations that arose before access ended, including unpaid charges or liability for prior violations.

Sections intended by their nature to continue—including intellectual property, disclaimers, liability limitations, indemnification, governing law, and dispute provisions—will survive termination.

18. Disclaimer of Warranties

Nothing in these Terms excludes warranties or consumer protections that cannot legally be excluded.

To the fullest extent permitted by applicable law, the website and Services are provided on an “as available” and “as is” basis. We do not promise that:

The website will always be uninterrupted or error-free
Every defect will be corrected immediately
All information will remain complete or current at all times
The Services will meet every individual expectation

Any express product warranty offered by ZUNQEVARO will be described separately. Except for such express warranties and rights imposed by law, we disclaim implied warranties to the maximum extent permitted, including implied warranties of merchantability, fitness for a particular purpose, title, durability, and non-infringement.

19. Limitation of Liability

Nothing in these Terms limits liability where such a limitation is prohibited by law.

To the maximum extent permitted by law, SUNNILAND PATIO, INC., ZUNQEVARO, and their directors, officers, employees, contractors, affiliates, licensors, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential losses arising from use of the Services or merchandise purchased through them.

This may include loss of revenue, profits, savings, data, business opportunity, or replacement costs, even if the possibility of such loss was known.

Where liability cannot be excluded but may be limited, our aggregate liability will not exceed the amount paid for the product or order giving rise to the claim, unless applicable law requires a different remedy.

20. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless SUNNILAND PATIO, INC., ZUNQEVARO, Shopify, and their respective affiliates, officers, employees, agents, contractors, licensors, and service providers from third-party claims, liabilities, losses, and reasonable legal expenses arising from:

Your material breach of these Terms
Your unlawful use of the Services
Your infringement of another party’s rights
Content you submit through the Services

This obligation does not apply to losses caused solely by a protected party’s own unlawful conduct where indemnification is prohibited.

21. Severability

If a court determines that part of these Terms is unlawful or unenforceable, that provision will be limited or removed only to the extent necessary.

The remaining provisions will continue in full force and effect.

22. No Waiver and Entire Agreement

A failure or delay in enforcing a provision does not waive our right to enforce that provision later.

These Terms, together with the policies and notices incorporated by reference, constitute the agreement governing your use of the Services and replace prior discussions or communications about the same subject.

If a specific store policy conflicts with these Terms, the more specific policy will govern the subject it addresses unless applicable law requires otherwise.

23. Assignment

You may not assign or transfer your rights or responsibilities under these Terms without our prior written consent.

We may assign these Terms as part of a merger, restructuring, sale of assets, corporate reorganization, or transfer of the business, subject to applicable law.

24. Governing Law and Jurisdiction

These Terms and disputes arising from the Services will be governed by the laws of the State of Florida, without regard to conflict-of-law principles.

Unless mandatory consumer law provides otherwise, disputes will be submitted to the state or federal courts having jurisdiction in Palm Beach County, Florida, and the parties consent to the jurisdiction of those courts.

Customers may retain additional mandatory rights under the laws of their place of residence.

25. Changes to These Terms

We may revise these Terms to reflect changes in our Services, business practices, technology, or legal obligations.

The updated version will be posted on this page with a revised effective date. Where legally required, we will provide additional notice of material changes.

Continued use of the Services after updated Terms become effective constitutes acceptance of those revisions, except where separate consent is required by law.
